TAYCAN RENT A CAR L L C Terms and Conditions

Delivery, Extension, Return and Exchange

• Minimum Rental Period: The minimum rental period is one day (24 hours) with a maximum grace period of 60 minutes from the agreed term. Late returns exceeding the grace period will incur an additional daily charge at the applicable rate, including fees for any value-added services.
• Extensions: The customer must inform TAYCAN in advance about any required extension of the rental contract. Failure to return the vehicle on the due date without notifying TAYCAN will result in automatic agreement renewal, with applicable charges to be settled within 24 hours.
• Agreement Validity: This Rental Agreement remains valid until the Vehicle is returned to the agreed drop-off location.
• Vehicle Condition: By accepting the Vehicle, the Renter confirms that the rental Vehicle is in the same condition indicated on the Vehicle Check List and accepts full liability for any further damage or loss, however caused. Responsibility remains with the Renter until the Vehicle is returned and checked in by an authorized TAYCAN representative.
• Return Requirements: The Renter agrees to return the Vehicle with all documents and accessories (original registration, tools, and accessories) and in the same condition as received, at the location and time stated in the Agreement.
• Right to Repossess: TAYCAN reserves the right to repossess the Vehicle at any time if the Vehicle is used in violation of the Agreement or if financial obligations are not settled.
• After Hours Return: If the Renter returns the Vehicle outside working hours, the Renter must comply with TAYCAN’s return instructions. The Renter is fully responsible for the Vehicle until it is checked in by TAYCAN.
• Collection/Alternative Return Locations: If TAYCAN agrees to collect the Vehicle or allows a return at a different location, the Renter is fully responsible for the Vehicle until TAYCAN collects or checks it in.
• Property Risk: TAYCAN is not liable for loss or damage to property left in the Vehicle during or after the rental period.
• Vehicle Replacement: The rented Vehicle may need to be replaced for service, sale, or other reasons. The Renter must return the Vehicle upon request. Delays in returning the Vehicle may result in financial obligations for damages or service delays.
• Temporary Upgrades: If the requested vehicle is unavailable, TAYCAN may issue an upgrade temporarily. Upon availability, the Renter must exchange the upgraded vehicle for the requested one, or be charged for the upgrade if exchanges are unsuccessful.
• Early Termination: Ending a monthly contract early will result in higher rates calculated based on the actual days used.
• Failure to Return: If the Renter does not return the Vehicle on the expected date or violates terms, TAYCAN reserves the right to:

  • Report the vehicle as stolen or missing to the Police.
  • Remotely disable the vehicle’s engine without prior notice while continuing to charge rental fees.
  • Repossess the vehicle without prior notice.
  • File a police case for unpaid dues.
  • Impose a late fee of 2% on unpaid installments, alongside recovery fees and damages, until full settlement is made.

Personal Data

The Renter authorizes TAYCAN to share personal data with authorities as necessary, including police and traffic departments.

Rates & Modification

Rates are subject to change if modifications are made to the booking after reservation confirmation. Extensions or reductions may lead to rate adjustments.

Conditions of Use

• Vehicles must not be used to carry persons, property, or goods for hire without prior approval from TAYCAN.
• Do not exceed passenger capacity or carry harmful items that could damage the vehicle.
• No towing, racing, or off-road driving is permitted.
• Driving under the influence of alcohol, hallucinatory drugs, or any other impairing substances is strictly prohibited.
• Vehicles cannot be sub-rented or driven outside the country without prior approval and proper documentation.
• Vehicles must not be used in restricted geographical areas or for illegal purposes.
• Only authorized drivers listed in the rental agreement may operate the vehicle.

The Renter agrees to be liable for any legal consequences or liabilities, bear all costs and expenses, and indemnify TAYCAN against any losses or damages resulting from a breach of these conditions.

Insurance Policy

• Comprehensive insurance is included, with optional upgrades for Collision Damage Waiver (CDW) or Personal Accident Insurance (PAI).
• In case of a Collision Damage Waiver (CDW) agreement, liability for vehicle damages is limited to a non-waivable amount, subject to providing a valid police report.
• Super Collision Damage Waiver (SCDW) exempts the Renter from liability for vehicle damage, excluding theft, provided that a valid police report is presented.
• Personal Accident Insurance (PAI) covers medical expenses and accidental death, subject to daily premium payments.
• Insurance for usage outside the UAE is limited to damage claims and requires submission of proper documentation.

Damage/Loss, Theft, etc.

• In the event of damage, loss, or theft of the vehicle or its parts, the Renter is liable for costs unless terms and conditions are met.
• The Renter is fully responsible for damages caused by contaminated fuel, floodwater, or off-road driving.
• Loss of revenue due to unavailability of the vehicle will be compensated by charging the rental rate until availability is restored.
• Accidents must be reported immediately to TAYCAN and police to obtain a valid police report.
• Failure to provide a police report invalidates the Collision Damage Waiver (CDW) and other insurance coverage.
• No repairs are to be carried out without prior written approval from TAYCAN.
• Tire and window damages are not covered under insurance and are the Renter's responsibility.
• The Renter must assist in all claims or legal matters related to the vehicle.

Governing Law and Jurisdiction

This Agreement is governed by UAE law. Disputes will be resolved in UAE courts.

Charges

• TAYCAN reserves the right to change its policies, including applicable rates, at any time without notice.
• Monthly rentals have a fixed mileage allowance per month. Excess mileage is charged per additional km based on car type.
• Salik toll fees (AED 5 per crossing) and service fees (AED 50 per traffic violation) are applicable.
• Admin charges apply for additional services like police reports, traffic fine evidence, or vehicle release from impound.
• Detailing charges are applicable if vehicles require specialized cleaning upon return.
• Fees for roadside assistance, recovery, or towing due to negligence or default are charged to the Renter.
• TAYCAN is authorized to debit rental and ancillary charges from the Renter’s credit card.

Payment, Cancellation & Refunds

• Payments are accepted via Visa or MasterCard. No cancellation or no-show fees apply currently.
• Customer credit card details are kept confidential and not shared with third parties.
• Refunds for cancellations are processed within 7 working days of the cancellation. Claims must be made within 30 days from the pick-up date.
• Refunds are processed 20 days after the Rental Agreement's termination, deducting outstanding dues, if any.
• Refund claims for invalid credit cards should be submitted within six months of vehicle return. No refunds apply for early returns on daily or weekly rentals.

Indemnity

Save for fraud and gross negligence, TAYCAN shall not be held liable or responsible for any loss or damage incurred to or suffered by the Renter or any third party in connection with the rented vehicle.

The Renter agrees to indemnify and hold TAYCAN (and its subsidiaries, affiliated companies, employees, and agents) harmless from and against all damages, losses, costs, expenses, actions, proceedings, claims, and demands arising from or connected with the Renter’s breach of its obligations under this Agreement or with their use of the vehicle.

Language and Interpretation

This Agreement is drafted in English. In case of conflicts, the English version prevails.

Guaranteed Make & Model

TAYCAN guarantees specific car models but may provide an upgrade if unavailable, with an option for exchange once the requested vehicle is available.
